Making a Living in France More and more of our clients coming to live in France are too young to retire and so need to find some sort of employment. As it is difficult for a British ex-pat to get employment in a French company most tend to go instead for self –employment – the most common occupations being general builder, gardener, small shop owner, and of course, B&B or gite owner. There are also quite a few ex-pats gainfully employed with estate agents selling houses! One of the biggest problems for any self-employed business is the amount of money payable as soon as you start up. In France there are not only tax charges to take into account, there are also cotisations (social charges – rather like National Insurance). These start off at a high rate, typically 40% of net income, and rise yearly for the first three years regardless of your income.
To work legally in France you have to pay tax and cotisations, and to do this you have to be registered with the organisation that is specific to your profession. Your first step, therefore, is deciding what kind of work you are going to do, and therefore what category you fit into. There are three categories:
- Profession libérale (freelance): translators, accountants, doctors, lawyers, architects, writers, artists - Artisan (craftsperson): plumbers, carpenters, electricians - Commercant (trader): shopkeepers, restaurant owners, wholesalers
Go to URSAAF, they are in charge of cotisation payments and issuing you with a siret number that is your proof of being legal. It will also contact the other relevant organisations that calculate your payments for health and pensions.
The main business categories are:
Enterprise Individuelle (EI) or Travailleur Indépendant (one-person business): This is a popular status for the self-employed, who anticipate a modest turnover and do not intend to engage in large-scale financial activities. If you earn under €27 000 per year (the current threshold), you can opt for what is called the ‘micro BNC’ on your tax return. This allows you to keep your accounts simple and declare your own turnover, in which you get an abatement (reduction) of 37% for expenses.
Entreprise Unipersonnelle à Responsabilité Limitée, better known as an EURL (single person limited company): This is a ‘one shareholder company’ for enterprises based on one person although up to 50 partners are allowed. An EURL is a good idea if you are likely to earn a high amount of money as it allows you to pay yourself a fixed income for living expenses with the remainder of your earnings taken out as dividends Société à Responsabilité Limitée, better known as a SARL (Limited Liability Company): A common structure for small and medium-sized businesses with between 2-50 shareholders. The conditions are as for a EURL, although you may become a salaried employee of your SARL, entitling you to all the benefits of owning your own company, plus those of being a salaried employee.
Société Anonyme, better known as an SA (equivalent of a plc in the UK): The most common structure for larger business, you’ll need a minimum of seven shareholders and capital of around €37,000, of which half needs to be subscribed on the creation of the business, and the remainder in the five years afterwards.
What ever you decide to do, get professional advice. And remember, especially with leisure related businesses such as B7B or gites, there is no guarantee of income, so have a nestegg put away to tide you over years with poor returns.
